Terms of Service

These Terms govern access to and use of the Protect My Catalog website and enforcement platform (the “Service”). By using the Service you agree to these Terms on behalf of yourself and the organization you represent.

1. The Service

Protect My Catalog is a human-in-the-loop copyright monitoring and DMCA workflow tool. We surface likely-infringing material, capture evidence, and help your team prepare and file notices and complaints. The Service is an operational tool — it is not a law firm and does not provide legal advice.

2. Accounts & eligibility

Accounts are provisioned by an organization administrator. You are responsible for safeguarding credentials and for activity under your account. You must be authorized to act for the rights holder whose catalog you manage, and you must be at least the age of majority in your jurisdiction.

3. Acceptable use

  • Only submit enforcement requests for works you own or are authorized to represent.
  • Provide accurate information; notices and complaints are sworn statements with legal consequences.
  • Do not use the Service to harass, to file knowingly false claims, or to violate any law.
  • Do not probe, scrape, overload, or attempt to circumvent the security of the Service.

4. Human review & your responsibility

The Service’s classifier is advisory. A person in your organization reviews findings and approves notices before anything is filed. You remain responsible for the content and legal sufficiency of any notice or complaint submitted through the Service, including the good-faith and accuracy statements required by the DMCA and equivalent laws.

5. Copyright, DMCA & counter-notices

Takedown notices filed through the Service must comply with 17 U.S.C. § 512 and any applicable local equivalent, including a good-faith belief that the use is unauthorized and a statement made under penalty of perjury. Misrepresentations may expose the sender to liability under § 512(f). Recipients may submit counter-notices; you are responsible for evaluating and responding to them. 6. Customer data & ownership

You retain all rights to the catalog data and enforcement records you load into the Service. You grant us a limited license to process that data solely to provide and improve the Service. We process personal data as described in our Privacy Policy.

7. Service availability

We work to keep the Service available and accurate but provide it on an “as is” and “as available” basis. We may modify, suspend, or discontinue features, and we perform maintenance that may cause temporary downtime.

8. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any particular enforcement outcome — whether a host, registrar, or platform acts on a notice is outside our control.

9. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, and our aggregate liability arising out of the Service is limited to the amounts paid for the Service in the twelve months preceding the claim.

10. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your enforcement submissions, your breach of these Terms, or your violation of law or the rights of a third party.

11. Termination

Either party may terminate as set out in the applicable order or agreement. We may suspend access for violations of these Terms or to protect the Service. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.

12. Governing law & changes

These Terms are governed by the laws of the jurisdiction stated in your order (or, absent that, the jurisdiction of our principal place of business), without regard to conflict-of-laws rules. We may update these Terms; material changes will be notified, and continued use constitutes acceptance.
